The boundary line between Italian and Tunisian prisons is in the protection of human rights. The Italian Constitutional Court is aligning itself with the rulings of the European Court of Human Rights, for the protection of inviolable freedoms also for prisoners at 41 bis. Tunisia, on the other hand, is not a party to the European Convention on Human Rights; but a 2009 ECHR ruling – a year before the Arab Spring – addressed to Italy, sends a message on the risks for Tunisian detainees in the event of returning to their country. Many years later, the Tunisian Constitutional Court is still not operational.
