Tutela del minore e unificazione degli status

Il sistema di tutela del minore compie sicuramente un passo in avanti grazie all’approvazione della L. 10 dicembre 2012, n. 219 e del successivo decreto attuativo del 28 dicembre 2013 n 154. Entrambi, tuttavia non risolvono tutti i problemi di equiparazione tra i figli. L’unicità dello status filiationis, infatti, sconta la soluzione di numerosi problemi pratici di tutela dei minori figli di genitori non coniugati. Il problema non sembra risolto neanche dalla recente legge che regolamenta le convivenze senza matrimonio. Both, however, do not solve all the problems of equality among children. The uniqueness of filiationis status, in fact, affected the solution of many practical problems of protection of minor children of unmarried parents. The problem does not seem to even solved by the recent law regulating co-habitation without marriage.
