The paper focuses on the award of commercial sub concessions in non-aviation areas of airports. The purpose of this paper is to establish if there are obligations for the management company to hold public tender procedures for choosing subcontractors. Firstly, the paper starts with a focus on the elements in favor of the thesis which affirms the existence of adequate obligations of publicity for the airport management company in tendering administrative procedures. Then, the author rejects this theory and asserts that there aren’t any obligation set up by public law and belonging to the administrative status, neither for the management company that is a “body governed by public law” and the one which is only a “state-owned corporation”. On this particular point the paper refers to the most recent and proper case law as well as to the ultimate directive on the award of concession contracts 2014/23/EU. Therefore, the selection of the candidates is ruled by civil law, even in the case of the publication of an open tender offer procedure by the airport management company. Furthermore, civil law offers a set of suitable instruments in order to grant the principles of publicity, transparency and equality of treatment.
L’articolo esamina gli atti di affidamento delle subconcessioni commerciali nelle aree non aviation degli aeroporti. Il problema è quello di stabilire se vi siano e quali siano gli obblighi del gestore aeroportuale di tenere dei procedimenti di gara per la scelta del subconcessionario. Dopo aver ricordato gli argomenti a sostegno della tesi che afferma l’esistenza di veri e propri obblighi di evidenza pubblica a carico del gestore aeroportuale, l’articolo confuta tali argomenti e sostiene non ci sono obblighi di diritto pubblico, nè per il gestore che sia “organismo di diritto pubblico” né per quello che sia “impresa pubblica”. L’articolo richiama in proposito i precedenti più recenti della giurisprudenza ed esamina anche l’ultima direttiva in materia di concessioni di servizi 2014/23/UE. Pertanto, la selezione del contraente, anche quando il gestore pubblica un bando aperto per una gara, rientra nel diritto privato. Lo stesso diritto privato, peraltro, offre degli strumenti idonei a garantire i principi di pubblicità, trasparenza e parità di trattamento.
