Scrutinizing the horizons of competition means looking at the balance between prosecution and defense in the public enforcement process and the experience that a successful institution, such as the Competition and Market Authority, has gained so far. The challenges today are perhaps even more demanding than in the past: balancing antitrust supervision on new market powers between platforms and sharing economy; granting consumer protection the right weight in public enforcement; being aware of the various powers that AGCM is called upon to perform with respect to the other authorities. However, scrutinizing horizons means above all examining the phenomenon in a unified way, bringing together the three protagonists: the AGCM, the administrative judge who exerts control over public enforcement decisions and the civil judge who is responsible for private enforcement, reinvigorated by the most recent EU Regulation. The fate of the three protagonists is increasingly intertwined and the assessment made by one is destined to influence that of the other, in a common experience; and this especially after the entry of the guarantees required by the ECHR, also on the front of full jurisdiction, and after the binding effectiveness of the public enforcement measure against the civil damages claim provided for by article 7 of Legislative Decree 3 of 2017.
Scrutare gli orizzonti della concorrenza significa guardare agli equilibri tra accusa e difesa nel procedimento di public enforcement e all’esperienza che un’istituzione di successo, come l’Autorità garante della concorrenza e del mercato, ha maturato sinora. Le sfide sono, oggi, forse ancor più impegnative che nel passato: calibrare la vigilanza antitrust sui nuovi poteri di mercato tra piattaforme e sharing economy; dare alla tutela dei consumatori il giusto peso nel public enforcement; avere contezza delle diverse funzioni che AGCM è chiamata a svolgere rispetto alle altre autorità. Scrutare gli orizzonti significa però soprattutto esaminare il fenomeno in modo unitario, accomunandovi i tre protagonisti: l’AGCM, il giudice amministrativo che esercita il controllo sulle decisioni di public enforcement e il giudice civile a cui spetta il private enforcement, rinvigorito dalla più recente disciplina di matrice europea. Il destino dei tre protagonisti è sempre più intrecciato e l’accertamento compiuto dall’uno è destinato ad influire su quello dell’altro, in un’esperienza comune; e ciò specialmente dopo l’ingresso delle garanzie richieste dalla CEDU, anche sul fronte della full jurisdiction, e dopo l’efficacia vincolante del provvedimento di public enforcement nei confronti del giudizio civile di risarcimento dei danni previsto dall’articolo 7 del decreto legislativo 3 del 2017.
