The article deals with the innovations introduced by the so-called simplifications decree (law decree No. 76 of 2020) in the Italian administrative Judicial review. The partial replacement of damage claims with respect to the annulment of the administrative decision in order to protect the effectiveness of the contract points out the importance of the urgent measure proceeding phase and could trigger crucial modifications also on an organizational level. The article then examines the Italian Jurisdiction separation between the Administrative judge and the Ordinary judge in the field of public procurement and addresses the problem of how the simplification decree will affect this issue. In fact, there are evident expansive tendencies of the Ordinary judge in this regard which could find a further space if the urgent measure proceeding phase of the administrative Judicial review were not carried out according to the requirements set by the principle of effectiveness of the Judicial protection. The article also deals with the problem of the relationship between administrative self-protection power and the effects of the contract of the administration, which could arise more frequently after the simplification decree
L’articolo esamina le novità introdotte dal cosiddetto decreto semplificazioni (decreto legge n. 76 del 2020) nel processo amministrativo. La parziale sostituzione del risarcimento del danno rispetto alla tutela di annullamento al fine di proteggere l’efficacia del contratto rilancia l’importanza della fase cautelare e potrebbe provocare modifiche importanti anche sul piano organizzativo. L’articolo esamina quindi il riparto di giurisdizione tra giudice amministrativo e giudice ordinario in materia di contratti pubblici e affronta il problema di come il decreto semplificazioni potrà incidere su questo argomento. Esistono infatti in proposito evidenti tendenze espansive del giudice ordinario che potrebbero trovare uno spazio ulteriore se la fase cautelare del processo amministrativo non fosse svolta secondo le esigenze poste dal principio di effettività della tutela. L’articolo tratta anche del problema del rapporto tra autotutela amministrativa ed effetti del contratto, che potrebbe presentarsi più frequentemente dopo il decreto semplificazioni
