Diritti reali e nuovi beni

The paper retraces Mario Allara's theses on the subject of goods in the juridical sense in order to highlight their innovations. In particular, it dwells on the difference between thing and legal good, on the emersion of the concept of legal good with respect to that of economic good and on the relational theory developed by the Master. Two important conclusions emerge from the study of the correlations between legal good and property right: the necessarily relational character between the subjects of the property relationship and the autonomy of the concept of legal good with respect to the theory of real rights.

Lo scritto ripercorre le tesi di Mario Allara in tema di beni in senso giuridico per evidenziarne gli spunti di novità. ln particolare, ci si sofferma sulla differenza tra cosa e bene giuridico, sull’emersione del concetto di bene giuridico rispetto a quello di bene economico e sulla teoria relazionale sviluppata dal Maestro. Dallo studio delle correlazioni tra bene giuridico e diritto di proprietà emergono due importanti conclusioni: il carattere necessariamente relazionale tra i soggetti del rapporto di proprietà e l’autonomia del concetto di bene giuridico rispetto alla teoria dei diritti reali.
